Subject: Behind the Bribe and How A Risk-Based Compliance Program Misses Risk

 

In 2007, Richard was targeted by the US Department of Justice in part due to an investigation of a UN supply contract and was terminated by his employer. In that same year, as part of a cooperation agreement with the United States Department of Justice and subsequent Immunity from Prosecution in the United Kingdom, Richard assisted the United States, Great Britain, and other governments in their understanding of how FCPA, bribery and other export violations occurred and operated in international sales.

 

Richard’s cooperation, which spanned three years of covert cooperation and two years of trial preparation and testimony, was one of the longest in a white-collar criminal investigation. In 2012, Richard was sentenced as part of his own Plea Agreement, and served fourteen-and-a-half months at a Federal Prison Camp. Richard was released in December of 2013.

In this session, Richard shares his experience on anti-corruption and ethical challenges from the field of international business, reflecting on his own perspective and practice as a former sales executive and law enforcement cooperator.

    Subject: Draft Fantasy Sports: Skill, Luck, or Fraud?
  • FanDuel and DraftKings have enjoyed an exemption from the federal Unlawful Internet Gambling Enforcement Act of 2006 to quickly become billion dollar daily fantasy sports companies. However, their legality is now being contested by various individual states. Both companies were investigated by the New York Attorney General and dozens of class action lawsuits were filed alleging fraud, conflicts of interest and misuse of inside information. This presentation takes a closer look at these controversial companies in an attempt to understand whether they may have committed fraud and to discuss the likely impact of new regulatory scrutiny that could jeopardize their future.

  • In this session, you will learn:

  • How daily fantasy sports work;
  • The nature of the regulatory actions being pursued against daily fantasy providers; and
  • How daily fantasy providers may be committing fraud.

About The Speakers:

Richard Bistrong spent much of his career as an international sales executive in the defense sector and currently consults, writes and speaks on foreign bribery and compliance issues from that front-line perspective. Richard’s experience included his role as the Vice President of International Sales for a large, publicly traded manufacturer of police and military equipment, which required his residing and working in the UK. For well over ten years, Richard traveled overseas in his sales responsibility for approximately 250 days per year.

Richard currently consults with organizations through his company, Front-Line Anti-Bribery LLC, and welcomes the opportunity to exchange and share perspectives on real-world anti-bribery and compliance challenges.  Richard has shared his experience, via keynotes and panels, with the OECD, World Bank, International Anti-Corruption Academy, as well as major multinationals and leading academic institutions. Jim Conversano is currently a Director in BRG's Capital Markets Group located in Washington, D.C. For over two decades, Jim has provided expert financial, investment management, regulatory, compliance and forensic investigation services to attorneys and clients in numerous civil and criminal litigation matters. Jim has provided verbal and written testimony, and has extensive experience providing expert analyses, drafting expert reports and leading investigative teams and projects.

In addition to being a Certified Fraud Examiner and a member of the DC-ACFE, Jim is currently serving as a member of the CFA Institute’s Disciplinary Review Committee, which is responsible for the enforcement of the CFA Institute Code of Ethics and Standards of Professional Conduct. Jim recently spoke at the 26th Annual ACFE Fraud Conference & Exhibition in Baltimore, Maryland on the topic of “The War Against Herbalife: Pyramid Scheme or Multi-Level Marketing Master?”
