FCPA and the UK Bribery Act

 

U.S. Foreign Corrupt Practices Act (FCPA) was enacted on 1977.  It is critical to be updated on the number of foreign bribery and corruption matters in recent years and the enhanced enforcement actions by the Regulators. 

 

The United Kingdom's Bribery Act of 2010 went into effect on July 1, 2011. The Act holds companies operating in any jurisdiction accountable to prevent and detect corruption and bribery actions undertaken on its behalf directed at anyone, not just foreign officials.

 

How are these two prominent anti-corruption laws being enforced?  What is the impact on companies operating internationally?  What opportunities do CFE practitioners have to assist in prevention and detection of corruption under thaws statutes?  Additional topics of discussion will include areas of accounting responsibilities, compliance, current enforcement and regulatory trends. Prominent FCPA practitioners, including Attorneys, Forensic Accountants and Investigators will provide more insights into effective FCPA compliance programs and investigation techniques.

Converging Ethics, Governance and Culture - Who Owns Fraud?

Many companies struggle to determine who will be responsible for managing fraud proactively and reactively within their organization. Not having a coordinated effort can cause confusion in a company’s ability to respond to fraud.

 This confusion can cause companies to struggle to determine who will be responsible for managing fraud related issues and could ultimately place the company at greater risk.

This can include a lack of trust by employees in the anti-fraud initiatives of the company, inefficient and ineffective responses to allegations of fraudulent activity, and a dangerous deficiency in the sharing of knowledge throughout the company

As criminals become increasingly sophisticated, the number and breadth of fraud schemes directed towards commercial payments have increased. Our presenter will set the groundwork by examining recent cases of commercial payments fraud (ACH, Wire Transfer, and Check Fraud); provide perspectives on how this fraud is evolving; and discuss what it means for banks and business.  This training is designed to help identify and become more aware of Cyber Fraud Schemes.

This training will assist and teach you about the crime of identity theft and will provide detailed information to help you deter, detect, and defend against identity theft.  Financial investigators will learn how to aid clients in the detection and prevention of identity theft. Law enforcement will learn how to obtain resources and how to help victims of identity theft.  As a consumer, you can learn how to avoid identity theft – and learn what steps you need to take when your identity is stolen.

This year we have seen tremendous changes in the legal world involving fraud and the regulations around combating fraud.  The Washington Metropolitan Chapter of the Association of Certified Fraud Examiners (ACFE DC) will hold our annual meeting and daylong training session on Wednesday June 23, 2010.  In addition, we are pleased to announce this years Fraud Examiner of the Year award recipient. 

The training session will be divided into three sections: 

Section one will include a discussion of the basic legal elements of fraud presented by a well-known and highly respected member of the Certified Fraud Examiner (CFE) community.  In addition, we will get an update on the newly formed Financial Crisis Inquiry Commission established to "examine the causes, domestic and global, of the current financial and economic crisis in the United States”.

Section two will focus on two specific areas: updates to the bankruptcy laws and updates and new trends in workplace and employment fraud.  

Section three will focus on ethics for the certified fraud examiner, covering the basics, most frequent causes for disciplinary action, and ways to avoid the pitfalls.

NOVA IIA -The Reid Technique of Interviewing in Fraud Cases

The Northern Virginia Chapter of the Institute of Internal Auditors (NOVA IIA) have offered member pricing to our membership for their next seminar -- The Reid Technique of Intervewing in Fraud Cases.     

Presentation Overview

This program will focus on two primary topics:

Behavior Symptom Analysis


During this segment of the program you will learn the verbal and nonverbal behavior symptoms that are displayed by a person who is telling the truth during a non-accusatory interview, as well as those displayed by a person who is withholding or fabricating relevant information.  The specific behaviors discussed include attitude; posture; significant posture changes; grooming, personal and protective gestures; eye contact; and, verbal responses. The ability to recognize and evaluate these behaviors becomes particularly important in those cases in which the available investigative information does not definitively establish the credibility of the subject.

At the conclusion of this segment of the program, you will have a behavioral model for both the truthful and deceptive individual that can be used for the evaluation of subjects in future investigative interviews.


The Behavior Analysis Interview

Most investigative interviews consist of two types of questions – investigative and behavior provoking.  Investigative questions concern the subject’s version of events, alibi or activities at the time in question, developed by the traditional who, what, where, when, why and how type of questions.  Behavior provoking questions are ones that are used to assess the subject’s truthfulness by evaluating the nature of their response.  Truthful people answer the behavior provoking questions one way, while a deceptive person usually offers a different verbal response.  During this segment of the program you will learn how to phrase and ask the behavior provoking questions, and describe the type of answers to anticipate from the truthful and deceptive individuals.


Speaker:  

Joseph P. Buckley III is a forensic interviewer, detection of deception examiner, lecturer and consultant.  Mr. Buckley is President of John E. Reid and Associates in Chicago, Illinois.  He has been with the firm since 1971.  He is co-author of three books The Investigator Anthology; Criminal Interrogation and Confessions; and Essentials of The Reid Technique, as well as numerous articles and papers.  He is a contributing author to The Encyclopedia of Police Science and the Encyclopedia of Security Management.  He is a member of the International Association of Chiefs of Police, the American Society for Industrial Security, the American Management Association, the Chicago Crime Commission, as well as numerous other professional organizations.  Mr. Buckley has lectured extensively to law enforcement, government and business groups.

Interviewing and Body Language (Sold Out)

Financial investigators must look beyond the numbers to properly address allegations of  fraud. Gathering information from interviews is an integral part of the investigation process -- getting to the truth requires more than simply asking questions and recording answers. You will learn significantly more from an interview subject when you are able to identify signs of potential deception, which prompt you to  probe deeper and also politely but firmly shut down attempted evasiveness.

Interviewing is an art.  Our training event is designed to help you refine your soft skills set.  When do you have enough information and how do you know the level of honesty?   

The event will also focus on body language.  We will discuss the importance of the messages a person sends with expressions, gestures, cultural/regional differences, universal emotions, and deceptive tells.
